Instinct is an AI personal assistant that plugs into your accounts and does things for you. You give it a prompt, it replies or carries out the task, including purchases made on your behalf. It is for people who want an assistant to run their everyday transactions and errands.
You can follow the plain parts, but long, all-caps blocks hold the clauses that cost you.
Instinct's assistant acts for you. The terms count its actions as yours.
Instinct is an AI assistant that acts for you, and the terms treat what it does as your own doing. It can buy things and enter agreements on your behalf, and those bind you as if you signed them yourself. You own what you feed it. Instinct owns the assistant and the technology behind it, and it does not promise you the copyright in whatever the assistant makes. Money you pay does not come back.
"You hereby appoint the Services as your agent to enter into agreements, commitments or transactions on your behalf... Any such agreements or commitments shall be binding on you as if entered into directly by you."Section 3 · Actions
"Except to the extent required by applicable law, all payments are non-refundable."Section 4 · Paid services
The document never says how long Instinct keeps your Materials, or what becomes of them if it shuts down.
Running Instinct means handing it standing access to your other accounts. You let it reach in, copy, and index the data from every service you connect. Disconnecting one does not pull that data back; the indexed copy stays until you ask them to delete it. The privacy notice shows how far this reaches, up to your third-party usernames and passwords so the assistant can sign in as you, and health details it handles on your behalf. A separate acceptable use policy, now read here, sets the conduct rules and says the terms win if the two clash. There is a long list of restrictions, one account per person, and an eighteen-or-older floor.
"You also authorize Instinct to access, copy, collect, and index data from your Connected Services... even if you disconnect a Connected Service, Instinct may still use the indexed Connected Service Input data unless you follow the instructions to request deletion."Section 3 · Connected services
"Don't violate the law, violate the rights of others, or engage in harmful activities when using the Services."Acceptable Use Policy · Section 1
You delete the indexed copy at app.instinct.com/workspace; the privacy notice confirms a disconnect alone leaves the data in place. The words "unsafe" and "inappropriate" decide what actions you may take, and the documents define neither (Section 3).
Your data trains their models by default. Anything you put in can improve the product and train the AI. The opt-out in settings leaves two holes: they keep using whatever gets flagged for safety review, and any model already trained on your data stays trained. What you place in the Vault is the one thing they never train on. The privacy notice widens the picture. Training also feeds on how you behave, down to your keystrokes and clicks, and data stripped of your identity can serve any purpose at all. Data from a linked Google Workspace is the one carve-out they promise never to train on. Any feedback you send becomes theirs outright.
"You agree that Instinct may use Materials to develop, provide, maintain and improve the Services and Instinct's other products and services, including training AI models"Section 3 · Materials
"Instinct may use deidentified information for any purpose."Privacy Notice · Deidentified information
"All Feedback becomes the sole and exclusive property of Instinct... You hereby assign to Instinct any and all right, title and interest... in and to any and all Feedback."Section 7 · Ownership of feedback
The opt-out only looks forward. It stops model training and leaves the other improvements untouched (Section 3). Instinct says Google Workspace data stays out of training and out of ad targeting (Privacy Notice).
Disputes leave the courts. You arbitrate on your own through JAMS and give up class actions, with thirty days to opt out by email. If something goes wrong, the most you get back is a hundred dollars, or what you paid in the last six months, whichever is larger. You cover Instinct's legal bills, one way. It can delete your account with or without notice, for any reason or none.
"INSTINCT'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES FINALLY AWARDED SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00), OR THE AMOUNT YOU PAID INSTINCT FOR THE SERVICES, IF ANY, IN THE PAST SIX (6) MONTHS GIVING RISE TO THE CLAIM."Section 9 · Limitations of liability
"Instinct may suspend, disable, or delete your Account and/or the Services (or any part of the foregoing) with or without notice, for any or no reason."Section 11 · Termination
Small-claims, injunctive, and IP disputes stay out of arbitration, and the opt-out runs by email inside thirty days (Section 10). The privacy notice names who your data reaches, including third-party AI providers and business partners who may use it for their own ends on an aggregate or anonymized basis, and it says Instinct does not sell your data or hand it to data brokers. The SMS texts are sign-in codes; reply STOP or HELP, and carriers are not liable for a message that never arrives (SMS terms).

This explains what the documents say. It does not read the law for you, weigh whether a clause would hold up, or guess what happens if you break the terms. It is not legal advice, and it does not judge Instinct. Every quote is word-for-word from its source: the terms and privacy notice dated 26 August 2026, the acceptable use policy dated 20 August 2026, and the SMS terms dated 17 August 2026. The terms were read on 22 September 2026 and the linked documents on 23 September 2026. The privacy, acceptable-use, and SMS documents are now read and folded in, so this covers the full set of linked terms.
